IT for Scottish Law Firms: Confidentiality, Compliance and Uptime

Client confidentiality and Law Society expectations put legal practices under sharper IT scrutiny than most SMEs. Here is what a compliant, resilient setup looks like.

IT for Scottish Law Firms: Confidentiality, Compliance and Uptime

A law firm carries other people's most sensitive information, and the consequences of losing it are professional as well as financial. That raises the bar on IT well above the average small business.

    The business impact

A breach or extended outage in a legal practice hits three things at once: client confidence, regulatory standing and billable hours. Conveyancing fraud alone has made Scottish firms a repeat target, because criminals know completion funds move on predictable dates through email instructions.

Five priorities for a legal practice

    1. Lock down email properly. Most attacks on law firms start with a compromised mailbox and end with altered bank details. Enforce multi factor authentication on every account without exception, enable impersonation and spoofing protection, and set up a mail flow rule that flags external senders. Then adopt a hard rule that no payment details are ever accepted or changed by email alone without a callback to a known number.

    2. Protect the matter file, not just the server. Access to client matters should follow the file, with permissions by team and matter rather than a shared drive everyone can browse. Set up a proper document management structure so that a compromised account exposes one caseload rather than twenty years of client files.

    3. Prove your backups restore. Backup software reporting success means nothing until a file has been pulled back from it. Test a restore quarterly, document the result, and know your recovery time. If your case management system went down this afternoon, how long until fee earners are working again? You should be able to state a number.

    4. Build UK GDPR into the day to day. Data minimisation, retention schedules and controlled access are as much IT configuration as policy writing. Practical steps: retention rules on mailboxes and file stores, encryption on every laptop, and a documented process for leavers that removes access the same day.

    5. Plan for the case management system, not around it. Whether you run a cloud legal platform or a hosted one, your IT partner needs to understand its requirements: performance, integration with Microsoft 365, and who does what when it breaks. Agree escalation routes between your IT partner and your software vendor before you need them.

Questions worth asking your IT provider this week

    • Is multi factor authentication enforced on one hundred percent of mailboxes?
    • When was our last tested restore, and what was the recovery time?
    • Are all laptops encrypted, and can you prove it?
    • What happens to a departing employee's access, and how fast?
    • Are we in a position to pass Cyber Essentials today?

If any answer is vague, that is your priority list.

    The Orange Penguin take

For legal clients we build around confidentiality first: enforced MFA, least privilege access, encrypted devices, tested backups and monitored patching, with the evidence to show a client or an insurer when asked. Cyber Essentials tends to fall out of that work naturally, which is useful when a corporate client starts auditing its supply chain.

We work with practices across Dundee, Tayside and wider Scotland, and we speak to fee earners in plain terms rather than acronyms.
